Terms of Service
1. Introduction
Welcome! Amolyus ("Company", "we", "us", "our") provides a community tool for Discord and Telegram that allows you to manage your community through configurable token ownership rules. Those rules allow to configure automated access granting to your community members, with features including but not limited to token verification, automated role assignment, and DAO-like functionalities (together, the "Services"). These Terms of Service ("Terms") set forth our legal obligations to each other and govern your access to and use of our Services. Please read these Terms carefully before accessing our Services. By using our Services, you accept and agree to be bound by these Terms and our Privacy Policy, available at [link to Privacy Policy]. If you do not agree to these Terms, you may not access or use our Services.
2. Eligibility
The Services are offered to and available to users who are at least 18 years of age. By accessing and using our Services, you represent and warrant that you meet these eligibility requirements. If you do not meet these requirements, you may not access or use our Services.
3. ENFT Subscriptions
3.1 ENFT Description
Our Services are offered through the sale of Expirable Non-Fungible Tokens (ENFTs), which act as time-limited subscriptions to access specific features based on the tier and functionalities of the ENFT purchased.
3.2 Tiers and Functionalities
We offer different tiers of ENFTs, each corresponding to a different level of access and functionality. Specific details regarding the features and limitations of each tier are provided on our pricing page [link to pricing page] or in your purchase agreement.
3.3 ENFT Expiry and Renewal
ENFTs are valid for a specific period, as indicated at the time of purchase. Upon expiry, access to the Services will be revoked unless a new ENFT is purchased.
3.4 Free Trial
We may offer a Free Trial ENFT that grants access to the Services for a limited period. After the Free Trial period, if you do not purchase a full ENFT, access to the Services will be revoked. Free Trials are limited to one per customer.
3.5 Purchasing and Transfer
ENFTs are purchased via blockchain transactions. Ownership of the ENFT grants access to the Services as described but does not include any rights beyond those explicitly stated. ENFTs may be transferable depending on the terms of the specific ENFT, but any transfer will result in the new owner gaining the subscription rights, and the previous owner losing access.
4. Fees for Services
4.1 Free and Premium Tiers
Some basic features of our Services may be available at no cost. These features are limited in scope and functionality.
For access to additional features, premium tiers are available for a fee. The cost and included features for each premium tier are detailed on our pricing page [link to pricing page].
4.2 Payment and Renewal
All payments for premium tiers are due at the time of purchase and must be made via the accepted payment methods provided.Premium ENFTs are valid for a specific period as described at the time of purchase. You may renew your premium ENFT before its expiry to continue accessing premium features.
4.3 Changes to Fees
We reserve the right to change the fees for our Services at any time. Any changes in pricing will apply to future purchases or renewals and will not affect any current ENFTs during their validity period.
5. Refund Policy
We offer a 14-day refund period for all ENFT purchases. If you are not satisfied with the Service for any reason, you may request a refund within 14 days of your purchase. To request a refund, please contact us at hello@amolyus.xyz. Refunds will be issued to the original payment method. This refund policy does not apply to any free trials or promotional offers.
6. Restrictions on Use
When using our Services on Discord or Telegram, you must comply with the respective platform's terms and conditions, as well as all applicable laws, rules, and regulations. You may only use the Services for authorized purposes and must not use the Services in any way that violates laws, infringes on intellectual property, or harms others.
7. Intellectual Property Rights
The Services and their features and functionalities (including, but not limited to, all information, software, text, displays, and images, and the design, selection, and arrangement thereof) are owned by Amolyus, its licensors, and other providers of such material, and are protected by intellectual property and proprietary rights laws. These Terms permit your use of the Services for their intended purpose, including managing your community on platforms like Discord and Telegram. However, you must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit the Services or any portion thereof, except as necessary in the authorized use of the Services. You may not use the Services to create a competing product, resell the Services, or otherwise use them in a manner that constitutes unauthorized commercial exploitation.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Amolyus, its affiliates, agents, directors, employees, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the services, any unauthorized access to or alteration of your ENFT, any interruption, failure, or cessation of the services, or any other matter related to the services. The services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Amolyus makes no warranty that the services will be uninterrupted, timely, secure, or error-free. Your use of the services is at your own risk. You agree that Amolyus's total liability to you for any damages, losses, or causes of action shall not exceed the amount you have paid to Amolyus in the twelve months prior to the event giving rise to the claim, if any.
9. Changes to the Services and Terms
We reserve the right to modify or discontinue the Services, or any part thereof, at any time without notice. We may also amend these Terms at any time by posting the updated terms on our website. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts of Australia.
